Sue is a 25 year old Latina woman who
arrived at the Shelter with her two children, ages 3 and 5 years old.
Sue had been living with the batterer for the past 7 months and had
married him four months ago. Sue had attempted to apply for residency
in the United States but her partner had destroyed her papers,
Therefore, it was impossible for her to obtain employment, housing,
AFDC, or food stamps. In addition, Sue did not have any identification
for herself or her children. Sue was in the process of being deported.
Staff contacted immigration to see exactly what process Sue needed to
follow to stay in this country. She would need to reapply under the
battered spouse residency classification, obtain her original marriage
license, birth certificates for herself, her husband and her children.
She would also need to obtain criminal records reports on herself and
for any domestic violence incidents that involved the police. She would
need $80.00 to file her immigration papers and money for copies of all
needed documents. Sue would need to hire an attorney. During her 58-day
stay at the shelter, staff was able to assist her with needed funds to
obtain all the documentation required, as well as the $80.00 filing
fee. Staff assisted Sue with filling out all the application forms.
Staff escorted Sue to court for her immigration hearing, where the
judge granted her a 3 month extension to stay in this country allowing
her time to obtain legal counsel and complete the immigration process.
